C3RS allows employees to report near-misses or close calls on railroads when they see them and ensures that the employees cannot be disciplined for reporting these events. Norfolk Southern has <\/span><a title=\"https:\/\/railroads.dot.gov\/railroad-safety\/divisions\/safety-partnerships\/c3rs\/participating-railroads\" contenteditable=\"false\" href=\"https:\/\/railroads.dot.gov\/railroad-safety\/divisions\/safety-partnerships\/c3rs\/participating-railroads\" target=\"_blank\" rel=\"noopener\"><span class=\"normaltextrun\">not yet joined<\/span><\/a><span class=\"normaltextrun\"> this program despite <\/span><a title=\"https:\/\/www.prnewswire.com\/news-releases\/norfolk-southern-joins-fra-close-call-reporting-system-301761613.html\" contenteditable=\"false\" href=\"https:\/\/www.prnewswire.com\/news-releases\/norfolk-southern-joins-fra-close-call-reporting-system-301761613.html\" target=\"_blank\" rel=\"noopener\"><span class=\"normaltextrun\">saying they would<\/span><\/a><span class=\"normaltextrun\"> shortly after the derailment affecting East Palestine and Darlington Township.<\/span><\/p>\n<p class=\"paragraph\"><span class=\"normaltextrun\">Last week, the <i>New York Times<\/i> <\/span><a title=\"https:\/\/www.nytimes.com\/2023\/08\/11\/us\/politics\/ohio-train-railroad-safety.html\" contenteditable=\"false\" href=\"https:\/\/www.nytimes.com\/2023\/08\/11\/us\/politics\/ohio-train-railroad-safety.html\" target=\"_blank\" rel=\"noopener\"><span class=\"normaltextrun\">published<\/span><\/a><span class=\"normaltextrun\"> a story detailing Norfolk Southern\u2019s hesitations about joining the program, specifically the company&#8217;s resistance to the provision that protects employees against retribution for reporting near-misses.<\/span><\/p>\n<p class=\"paragraph\"><span class=\"normaltextrun\"><b><i>\u201cC3RS is a promising program with real potential to improve rail safety, protect employees, and reduce incidents if adopted by a larger swath of the rail industry,\u201d <\/i><\/b><\/span><span class=\"normaltextrun\">wrote the Senators. <b>\u201c<i>C3RS acts as one unified database for reporting and, with NASA as an independent third-party administrator, ensures confidentiality and protects against retribution against employees who make reports. Ensuring that employees are not disciplined for reporting near-misses is key to making the program effective, as employees are more likely to report these incidents when they have a guarantee of anonymity and safety from retribution.\u201d<\/i><\/b><\/span><\/p>\n<p class=\"paragraph\"><span class=\"normaltextrun\"><b><i>\u201c&#8230;After the East Palestine derailment, Norfolk Southern announced on March 2 that it would join the C3RS report system. In the announcement, you stated that the move \u2018marks another step [Norfolk Southern is] taking to further [your] commitment to safety.\u2019 However, since your initial announcement, you have not followed through on this pledge. We believe that fully participating in C3RS would be a positive step for Norfolk Southern in committing itself to a culture of safety,\u201d<\/i><\/b><\/span><span class=\"normaltextrun\"> the Senators continued.<\/span><\/p>\n<p class=\"paragraph\" align=\"center\"><a title=\"https:\/\/projects.45press.com\/fetterman-old\/wp-content\/uploads\/2023\/08\/Fetterman-Casey-Letter-re-C3RS.pdf\" contenteditable=\"false\" href=\"https:\/\/projects.45press.com\/fetterman-old\/wp-content\/uploads\/2023\/08\/Fetterman-Casey-Letter-re-C3RS.pdf\" target=\"_blank\" rel=\"noopener\"><span class=\"normaltextrun\"><b>The full letter is available HERE.<\/b><\/span><\/a><\/p>\n<p class=\"paragraph\"><span class=\"normaltextrun\">Also last week, the Federal Railroad Administration released a <\/span><a title=\"https:\/\/railroads.dot.gov\/sites\/fra.dot.gov\/files\/2023-08\/2023%20NS%20Safety%20Culture%20Assessment_08.09.23.pdf\" contenteditable=\"false\" href=\"https:\/\/railroads.dot.gov\/sites\/fra.dot.gov\/files\/2023-08\/2023%20NS%20Safety%20Culture%20Assessment_08.09.23.pdf\" target=\"_blank\" rel=\"noopener\"><span class=\"normaltextrun\">new report<\/span><\/a><span class=\"normaltextrun\"> on the disaster that recommended Norfolk Southern join the program.<\/span><\/p>\n<p class=\"paragraph\"><span class=\"normaltextrun\">The new letter is just one measure in a series of actions that Sens. Casey and Fetterman have taken to push for accountability from Norfolk Southern and stand up for local residents affected by the toxic derailment.<\/span><\/p>\n<p class=\"paragraph\"><span class=\"normaltextrun\">Earlier this year, Sen. Fetterman <\/span><a title=\"https:\/\/projects.45press.com\/fetterman-old\/?post_type=press_releases&amp;p=6469&amp;preview=true\" contenteditable=\"false\" href=\"https:\/\/projects.45press.com\/fetterman-old\/?post_type=press_releases&amp;p=6469&amp;preview=true\" target=\"_blank\" rel=\"noopener\"><span class=\"normaltextrun\">held<\/span><\/a><span class=\"normaltextrun\"> a roundtable with local farmers in Darlington Township affected by the derailment, while Sen. Casey <\/span><a title=\"https:\/\/www.cbsnews.com\/pittsburgh\/news\/sen-bob-casey-beaver-county-rail-safety-legislation\/\" contenteditable=\"false\" href=\"https:\/\/www.cbsnews.com\/pittsburgh\/news\/sen-bob-casey-beaver-county-rail-safety-legislation\/\" target=\"_blank\" rel=\"noopener\"><span class=\"normaltextrun\">visited<\/span><\/a><span class=\"normaltextrun\">\u00a0Darlington Township to push for rail safety bills and hear from residents.<\/span><\/p>\n<p class=\"paragraph\"><span class=\"normaltextrun\">Previously, Sens. Casey and Fetterman <\/span><a title=\"https:\/\/www.casey.senate.gov\/imo\/media\/doc\/letter_to_norfolk_southern_on_east_palestine_train_derailment.pdf\" contenteditable=\"false\" href=\"https:\/\/www.casey.senate.gov\/imo\/media\/doc\/letter_to_norfolk_southern_on_east_palestine_train_derailment.pdf\" target=\"_blank\" rel=\"noopener\"><span class=\"normaltextrun\">wrote<\/span><\/a><span class=\"normaltextrun\">\u202fto Shaw about the company\u2019s legal and moral obligation to the residents of East Palestine and Darlington Township, demanding answers on how the company plans to be an active member of response and clean-up operations. They\u202f<\/span><a title=\"https:\/\/www.casey.senate.gov\/imo\/media\/doc\/letter_to_epa_about_ns_derailment.pdf\" contenteditable=\"false\" href=\"https:\/\/www.casey.senate.gov\/imo\/media\/doc\/letter_to_epa_about_ns_derailment.pdf\" target=\"_blank\" rel=\"noopener\"><span class=\"normaltextrun\">pressed<\/span><\/a><span class=\"normaltextrun\">\u202fthe Environmental Protection Agency on its plan to hold Norfolk Southern accountable for releasing hazardous materials into the air and water. They\u202f<\/span><a title=\"https:\/\/www.casey.senate.gov\/imo\/media\/doc\/letter_to_ntsb_about_ns_derailment.pdf\" contenteditable=\"false\" href=\"https:\/\/www.casey.senate.gov\/imo\/media\/doc\/letter_to_ntsb_about_ns_derailment.pdf\" target=\"_blank\" rel=\"noopener\"><span class=\"normaltextrun\">wrote\u202f<\/span><\/a><span class=\"normaltextrun\">to the National Transportation Safety Board (NTSB) to share rail safety concerns they have heard from constituents, rail experts, and railroad workers as NTSB conducts its investigation into the derailment.\u202fAnd finally, they worked with Congressman Chris Deluzio (D-PA) to\u202f<\/span><a title=\"https:\/\/www.casey.senate.gov\/imo\/media\/doc\/casey-fetterman-deluzio_letter_to_norfolk_southern_about_zip_codes.pdf\" contenteditable=\"false\" href=\"https:\/\/www.casey.senate.gov\/imo\/media\/doc\/casey-fetterman-deluzio_letter_to_norfolk_southern_about_zip_codes.pdf\" target=\"_blank\" rel=\"noopener\"><span class=\"normaltextrun\">urge<\/span><\/a><span class=\"normaltextrun\">\u202fNorfolk Southern to provide assistance to Pennsylvanians in Darlington Township after repeated reports that Pennsylvania residents were being turned away at the Family Assistance Center in East Palestine.<\/span><\/p>\n<p class=\"paragraph\"><span class=\"normaltextrun\">The Pennsylvania Senators also joined with Sens. Sherrod Brown (D-OH) and J.D. Vance (R-OH) to introduce the bipartisan\u202f<\/span><a title=\"https:\/\/www.brown.senate.gov\/download\/railway-safety-act-of-2023-text\" contenteditable=\"false\" href=\"https:\/\/www.brown.senate.gov\/download\/railway-safety-act-of-2023-text\" target=\"_blank\" rel=\"noopener\"><span class=\"normaltextrun\"><i>Railway Safety Act of 2023<\/i><\/span><\/a><span class=\"normaltextrun\">\u202fwhich would take much needed steps to improve rail safety protocols and prevent future train disasters like the derailment that devastated East Palestine and Darlington Township. The bill will take key steps to improve rail safety protocols, such as enhancing safety procedures for trains carrying hazardous materials, establishing requirements for wayside defect detectors, creating a permanent requirement for railroads to operate with at least two-person crews, increasing fines for wrongdoing committed by rail carriers, and more.<\/span><\/p>\n","protected":false}}
